PERSONAL STORY

Born and raised in New Hampshire, David cultivated an early appreciation for nature and the outdoors. Growing up, you could often find him skiing the mountainsides with his race team, water skiing on the lake or playing a variety of outdoor sports. The thrill of competition and new challenges was addictive. Those closest to David will tell you that he constantly found new ways to push the limits. Even after being seriously injured on the mountain at a young age, David never gave up on pursuing his passions.

When he wasn’t enjoying the outdoors, David loved spending downtime with his family. David grew up in a large, tight-knit family spread throughout New England which instilled upon him the value of community and the importance of supporting each other through times of adversity.

David’s thirst for competitive challenge and desire to help others drove him to pursue a career in law.

Since joining the team at DILLER LAW in 2009, David has prosecuted a variety of personal injury cases, resulting in significant outcomes in favor of the firm’s clientele.

He has experience advocating for the rights of injured clients and their families through all stages of litigation, trial and appeal.

David takes pride in going the extra mile for his clients and fighting to make our communities safer by holding negligent individuals and corporations accountable for their wrongdoings. He believes strongly that positive change is actualized when unsafe individuals and companies are held responsible for the preventable harms and losses they cause.

David strives to continue his recent successes through his persistence, resourcefulness and dedication to his clients. He regularly attends legal education and training programs with some of the country’s most renowned personal injury attorneys to stay informed of current legal trends and litigation strategies.

David received a B.A. from Fairfield University in 2005 and earned his J.D. from Suffolk University Law School in 2009, graduating magna cum laude. During his time at Suffolk, David earned numerous recognitions and several awards for scholastic achievement in the field of law.

In his spare time, David still enjoys the outdoors including snowboarding, water sports, hiking, travel and, most importantly, his family.

Landlords Accountable To Tenant For Unsafe Rental Property

David helped a tenant hold his landlords accountable after a balcony guardrail collapsed causing the tenant to fall 2 stories below suffering spinal fractures and head injuries. David alleged that the residential landlords chose not to properly maintain the balcony guardrail system in a safe condition in violation of various building codes and safety regulations. The case settled favorably for the tenant for a confidential sum shortly before the start of trial.

Contractors Responsible For Injured Worker On Unsafe Construction Site

David represented an engineer injured on a large airport construction project. David alleged that the general and sub-contractors failed to guard against a dangerous, hidden fall hazard at the construction site in violation of OSHA regulations and company safety policies. David helped the injured worker procure a substantial settlement at Mediation prior to trial.

Verdict Against Distracted Driver

David obtained a favorable verdict on behalf of a client injured by a distracted driver following a jury trial in Essex Superior Court. The unsafe driver refused to accept responsibility by blaming his client for the crash and undermining his client’s injuries. The jury did not accept the Defendant’s excuses and compensated David’s client for his damages.

Cleaning Company Held Accountable For Slip & Fall At Massachusetts University

David helped a professor who was seriously injured when she slipped and fell on a recently mopped floor at a Massachusetts university. Through litigation, it was shown that the professional cleaning company disregarded standard safety practices intended to prevent slip and fall injuries on wet floors. The case settled on the first day of trial.

Judgment for pedestrian injured in motorized wheelchair

Attorney Mehan obtained a judgment against a motorist who struck a disabled man crossing the street in his motorized wheelchair. The plaintiff suffered significant injuries, including a fractured femur requiring surgery.

Arbitration Award For Bicyclist Struck By Car

David represented a bicyclist who was struck by a car while riding home from work. The bicyclist’s own insurance company refused to offer any compensation for his injuries by claiming the bicyclist was at fault for riding in the wrong direction on a busy main roadway. David arbitrated the case and recovered the insurance policy limits for the bicyclist.

Jury Verdict For Fall On Unsafe Property

David represented a real estate agent against the owner of a real estate agency who left open and unguarded an unsafe trap door in the floor. David’s client fell through the unguarded hole in the floor and suffered multiple injuries including, most significantly, a shoulder injury requiring surgery. The defendants contested liability and alleged comparative fault against the plaintiff. At trial, David and Marc Diller secured a favorable jury verdict on behalf of real estate agent.

Woman Injured By Dog Bite

David brought a claim against a dog owner after the owner’s dog viciously bit a young woman’s thigh when she went to greet the dog. David alleged “strict liability” against the dog owner and reached favorable settlement with the dog owner’s insurance company.

Motorcyclist Suffers Catastrophic Leg Injury

David helped a man who almost lost his leg when an on-the-clock driver pulled out from a parking space and struck his motorcycle. David brought a lawsuit against the driver and her employer alleging violations of company safety policies and procedures. The Defendants claimed the motorcyclist was speeding or impaired. Through use of a persuasive power point presentation at Mediation, the case settled for a significant sum.
