Question: If health insurance pays for needed medical-expenses resulting from a Massachusetts motor vehicle accident, does the injured person need to repay the health insurance for such accident-related medical benefits?
Answer: Such answer depends upon the language of the specific health insurance contract. You should review the language in your health insurance contract before you settle your case against the party legally-responsible for causing the accident. In general, most health insurance contracts provide that it has a right to be repaid (all accident-related medical benefits it paid) from the injured person’s settlement against the party legally responsible for causing the accident.
